Non-Refundable Policy: All payments made to TeamOnTime OS for dedicated engineering pod capacity, monthly retainer hours, or fixed-scope Statement of Work (SOW) milestone builds are strictly NON-REFUNDABLE.

Service Credits Provision: In lieu of cash refunds, TeamOnTime OS may, at its sole and absolute discretion, issue service credits that can be applied toward future engineering services offered by TeamOnTime OS. Service credits are valid exclusively for services provided by TeamOnTime OS, are non-transferable, and carry zero cash redemption value. No payment disputes or chargebacks will be honored for completed milestones or reserved developer pod capacity.

Confidentiality and trade secret protection obligations under our Master Terms survive account termination indefinitely, ensuring permanent brand protection.

04 • LIABILITY & JURISDICTION

Limitation of Liability Cap

To the maximum extent permitted by applicable law, TeamOnTime's total aggregate liability for any claims arising from services shall not exceed the actual fees paid by Agency in the three (3) months preceding the event.

Third-Party Tool Disclaimer

TeamOnTime is not liable for service downtime, platform API deprecations, or outages caused by third-party platforms including Shopify, WP Engine, AWS, Vercel, or external SaaS integrations.

Governing Law & Jurisdiction

These Master Terms are governed by the laws of India, including the Information Technology Act, 2000, subject to the exclusive jurisdiction of the competent Courts in Surat, Gujarat, India.

Dedicated pod hours (160h/mo) represent reserved senior developer allocation and do not roll over. Pooled monthly retainer hours allow up to 20% rollover into the immediately following billing cycle.

How are out-of-scope feature requests handled?

Requests exceeding approved SOW scope are estimated as a formal Change Order or absorbed into your active monthly pod allocation upon agency approval.
